The Crime Victims Compensation Act of Montana pays benefits to innocent victims who are injured or killed as a direct result of a crime. Innocent victims of DUI drivers can be compensated for incidents which occur on or after 7/1/91. The Act is administered through the Board of Crime Control.

Who may file a claim?

A claim can only be filed by:

  • the victim or
  • a person legally authorized to act on behalf of the victim (parent or guardian), and
  • dependent(s) of a deceased victim

Primary victim benefits include:

  • Medical
  • Wage Loss
  • Death Benefits

Secondary victim benefits include:

  • Mental health counseling for certain family members
